Diego helped the Flag Smashers haul boxes from the group onto a truck. The boxes held vaccines. On the road, they were attacked by Falcon, Bucky Barnes, Captain America, and Battlestar. Diego helped as the rest of the Flag Smashers took care of them.[1]
Arriving at a safe house, the group talked with Rudy, who supplied shelter. Karli Morgenthau then asked for their loyalty, which they gave. Later, they were loading the boxes onto a plane when they were notified that the Power Broker found them. As everyone left, Matias stayed behind to sacrifice himself.[1]
Diego met with the Flag Smashers in a ruined building. As they ate, they heard the news talk about them as terrorists. Diego then attended Donya Madani's funeral, staying by the side of Hector Lennox. They listened to Karli Morgenthau's speech and paid their respects.
Later, they were attacked by Falcon, Winter Soldier, Captain America and Battlestar. DeeDee and Diego were able to knock out Battlestar. DeeDee then told him to tie him up. They then attacked Captain America and Falcon. Diego was quickly knocked down by Walker's thrown shield. He then kicked Walker before pulling his knife. Diego's knife was pulled out of his hand as he was disposed of by Walker. Diego decided to go after a different enemy, charging towards Falcon. However, he was punched by Winter Soldier. Soon, Battlestar was killed, causing Walker to chase them down. He eventually decapitated Nico.[3]
New Plans[]
They returned to the settlement camp to find it raided. They looked at Global Repatriation Council flyers saying they arrested everyone. Diego knelt down in sadness as Karli Morgenthau ranted about the actions of the GRC against them as well as the deaths that had happened. They then flew to New York City to stop the Patch Act from happening.[4]
In New York City, new Flag Smashers helped break into the voting meeting to shut it down. Diego went to a helicopter and acted as the pilot so that officials would hop into it hoping to escape the attack. When this happened, Diego took off with the passengers, who did not suspect a thing. However, Diego saw Sam Wilson as Captain America. Diego went into a deep dive to evade.
Suddenly, the NYPD helicopter was on his tail. Diego was able to knock into Wilson, sending him into a bunch of concrete pillars. He also shot at Wilson, who used his shield and wings to deflect the bullets. Suddenly, Wilson came crashing through the window, taking Diego with him. The two fought in the air until Diego slammed into the water. Diego emerged very hurt, but alive. Captain America eventually found him.[5]

Artificially Enhanced Physiology: Diego was given Super Soldier Serum to help him and the Flag Smashers in their fight. This granted him unnatural abilities.
Enhanced Strength: Diego gained tremendous strength as a result of the serum.
Enhanced Durability: The Super Soldier was more resistant of physical attacks during battle.
Enhanced Speed: Diego was able to catch up to Bucky Barnes and even out run him for a short time.
Enhanced Agility: In addition to speed, Diego was also very agile and acrobatic as a result of the serum.
Enhanced Stamina: Diego was able to run for a tremendous amount of time before even breaking a sweat.
Enhanced Reflexes: Diego's reflexes were also enhanced enough to dodge enemy attacks.
Regenerative Healing Factor: Diego would be able to return to battle quickly if he ever got injured,
Longevity: Diego's life span was greatly extended as a result of the serum.
