Tobey was asked by Jeri Hogarth to help her in her divorce proceedings from Wendy Ross-Hogarth.[1]
Approached by Audrey Eastman
Tobey was approached by Audrey Eastman who said that she wanted a divorce from her husband Carlo; she told him that he was going out on Friday nights and she suspected that he was having an affair. Tobey advised her to hire Jessica Jones from Alias Investigations to get pictures of his tryst and that those pictures would help in case Carlo asked for alimony.
Later, Jones approached him to verify that he recommended her to Audrey Eastman; Tobey only told Jones that due to "attorney-client privilege" he could say nothing, annoying Jones and causing her to storm off.[1]
Lawyers' Meeting
Tobey and Jeri Hogarth met with Wendy Ross-Hogarth and her lawyer in the Hogarth, Chao and Benowitz Office to discuss Ross-Hogarth's demand that she wanted over 70% of Hogarth's assets: he tried to convince Ross-Hogarth that her demands were unreasonable. He listened as the two women argued with Ross-Hogarth saying that she was threatened to sign the divorce papers by Jessica Jones while Hogarth realized that her wife was still in love with her and still had hopes to have them reconcile. The conversation was interrupted as Pam entered the meeting room, telling Hogarth that she had an urgent call; Tobey was left in charge with implementing Hogarth's desires. Ultimately, Tobey failed to convince Ross-Hogarth to change her desires.[2]

Jeri Hogarth sent Tobey a text message asking him if he had any success in his negotiations with Wendy Ross-Hogarth; Tobey wrote back that Ross-Hogarth changed her demand to wanting 90% of Hogarth's assets.[3]
