Pierce argues with Tony Stark and Thor

In the aftermath of the Battle of New York, Alexander Pierce instructed his subordinate Jasper Sitwell and a HYDRA-aligned STRIKE team to head to Stark Tower in order to secure the Scepter from the Avengers, while Pierce stationed himself in the lobby in order to regain possession of the Tesseract. Pierce soon received a call from Sitwell that their acquisition was successful and that the Scepter would be delivered to List as planned. Pierce, along with his loyal S.H.I.E.L.D. agents, conversed with Thor and Tony Stark as he demanded that they relinquish custody of both the Tesseract and Loki. Thor noted that Loki, an Asgardian war criminal, would be served justice on Asgard by Odin.

Meanwhile, a man posing as a S.H.I.E.L.D. agent took possession of the Tesseract, only to be knocked aside by Hulk and causing the Tesseract to fall into Loki's possession. The surrounding onlookers, including Pierce, were aghast when Loki suddenly vanished, teleporting away and escaping from S.H.I.E.L.D. confinement.[1]
