No, but that's the lie Sony will use to renegotiate with Disney and calm things down to fix the mess. Yes, it's unethical, but Disney was greedy first. It's a matter of which wrong works best for the outcome.

The negotiations are still happening. I’m hoping that they’ll be able to pull through and just let marvel make spider man movies

He's supposed to reprise the role if everything goes out smooth. and yes, it's a Sony-Marvel contract but it's Sony first since they officially own the rights. They only share with Marvel Studios for films, whereas Disney owns animated shows and all merchandising profits.
