<p>Not totally sure about this one, but I've read that the Skrulls have shared rights, like Quicksilver and Scarlet Witch.
</p><p>Marvel probably can't use the Super-Skrull more commonly associated with the Fantastic Four, (Kl'rt, the one that has the four powers of the FF), but any other skrull should be available. They can like in Avengers: Earth Mightiest Heroes, and create their own super-skrull combining any set of powers available.

<p>the fact that Quicksilver is gonna be in Avengers 2 annoys me. im not quite sure why. anyways, the alien could be a kree and this could be a lead up to the Gaurdians of the Galaxy crossover
